MOORING SUB-PERMIT TERMS AND CONDITIONS

Mooring Sub-Permittee agrees:
  1. To be responsible for, and to pay for, any damage to the mooring equipment.
  2. To defend and indemnify the City of Newport Beach and any other government entity with jurisdiction against any claims or losses arising out of, or related to the use of the mooring or mooring rental.
  3. To provide valid government issued identification.
  4. To provide proof of insurance for the vessel.
  5. To provide registration or other proof of ownership of the vessel used in the mooring rental.
  6. To provide an equipment damage deposit (to be determined).
  7. To authorize the City of Newport Beach, or its designee, to move or relocate the Mooring Sub-Permittee’s vessel on the mooring to another location when deemed necessary by the City of Newport Beach for any reason at any time.
  8. To provide approved mooring lines which shall be removed at the end of the rental period.
  9. To a Mooring Sub-Permit for up to fifteen (15) days. Mooring Sub-Permit may terminate at any time for any reason, and may be renewed based on availability. Mooring Sub-Permittees have no right of renewal or substitute moorings upon return of the Mooring Permittee’s Assigned Vessel, or upon termination of a Mooring Sub-Permit for any reason. Mooring Sub-Permittees accept an indefinite term at their own risk.
  10. To pay the Mooring Sub-Permit rent based on a rate established by the Newport Beach City Council.
  11. Agree that live-aboards may be temporarily permitted as Mooring Sub-Permittees pending vessel inspection for approved marine sanitation devices and a dye tablet test, for a period not to exceed fifteen (15) days in any twelve (12) month period.
VIOLATION(S) OF MOORING SUB-PERMIT TERMS AND CONDITIONS, OR NBMC TITLE 17 AS AMENDED OR SUPERSEDED MAY RESULT IN THE TERMINATION OF MOORING PERMIT.
