The purpose of this letter is to request an opportunity to inspect or obtain copies of all public records related to the joint petition filed with the National Labor Relations Board (NLRB) between the City of Newport Beach and the Newport Beach Police Association regarding the exemption set forth in Section 207(b) of the Fair Labor Standards Act (FLSA), as well as any and all communications between the NLRB and the NBPA relating to that petition or the 207(b) exemption. This request includes the names of officers-involved, names of the deceased, the individual dates of each fatal incident, information about the deceased's race and gender, if the deceased was found to have suffered from mental health issues during the incident, and whether the deceased was found to have been armed or unarmed. The request, of course, pertains to Newport Beach PD patrol areas but also any instances where Newport Beach PD participated in an officer-involved shooting outside of city limits within the decade time frame I outline in my request.

I was looking through old minutes for something related to the recall of Mr. Peotter and came across a statement by Mr. Muldoon that I would like to explore. In the 2/9/16 meeting, in which the council inexplicably did not raise sewer rates to match costs, Mr. Muldoon said that he had received “hundreds of Emails from residents” about this. It is almost incomprehensible that such an arcane subject would cause a flood of Emails, but I am willing to give him the benefit of the doubt that his vote reflected the stated flood of Emails. I would be interested, however, in seeing those Emails. Do you need a formal public records act request for them? It seems very apparent that few people in this City are aware of how often road departure crashes have occurred along the high-speed curved sections in front of the homes over the last 40 years. If the City can track how busy or not are the park and the parking, it is obvious from my live observation every day and proven by the pictures that I sent, these following comments: During 9 month of the year ( September to May ) 1- Week days : park is almost empty, except some late afternoon when there is some practices. Parking is almost empty, whenever there is practice it is more than half empty. 2- On the weekends, during the some 9 months : Same condition, the park have few people except if there is practices or games . Park is almost empty, also half empty if there is games or practice. ** Exception to the above is very limited. DURING the other 3 months of year ( June to August ) 1- weekdays: the PARK is barely USED because of the heat . Parking usually is half empty , the people who use the parking, go to the beach NOT THE PARK . 2- Weekends : again PARK have few people . Parking usually is Full, with some few spots still empty, ALMOST ALL PEOPLE USING THE PARKING During THESE WEEKENDS GO TO THE BEACH .( 10 to 12 Weekends) ** Exception to the above is very limited. During 3 HOLIDAYS: 1- MEMORIAL DAY 2- FOURTH OF JULY 3- LABOR DAY During these 3 Holidays the PARK USUALLY HAVE FEW PEOPLE . PARK IS COMPLETELY PACKED BECAUSE PEOPLE GO TO THE BEACH . Again, this is for the records, I am sure of these facts almost 95% So, my questions are : RELEVANT QUESTION TO THIS TICKET: 1- As I asked in the last meeting about having City records of the parking Pay Stations, I believe these are public records , can you forward these information to me for last year ? Also, these information must be presented to the Public in specific and detailed as possible, so the public can have clear pictures about the statistic . 2- Also, with the low usage of the parking, How the city is proposing enlarging the parking 3 times its existing capacity ? while it is not used most of the year !! 3- How come the Commission even discussing the COST without first discussing the NEED OF ENLARGING THE PARKING ? 4- How come the CITY OFFICIALS Propose a Large project like that Without first Stand in front of the Commission and the Public, to prove the NEED of the parking enlargement ?
